Calgary's commercial lease market is presently undergoing substantial change, with high vacancy rates in certain sectors (primarily office space) and deflated rental rates. This however has not resulted in lease agreements becoming any less stringent. If anything, the landlords have increased their demands both in negotiations and in the restrictive nature of the lease agreements. As such it is very much akin to a hornets' nest of legal and financial demands that prospective tenants find themselves facing, with landlord's who are under pressure in the present market and thereupon employing every possible tactic to improve their position from an overall and long-term perspective.

As such, I must reiterate one of my most frequent points of consideration to prospective commercial tenants, and that is to obtain legal counsel prior to signing off on the Offer to Lease. For the reality that no one seems to properly tell prospective tenants, is that they should get the input of an experienced leasing lawyer prior to committing to the Offer to Lease, because the Offer becomes a legally binding agreement once signed and the big Lease Agreement that follows is simply an expanded version of the Offer, with the tenant having effectively committed to its terms (subject to minor inconsistencies, if any, that simply need to be corrected) and there really is little room to alter or negotiate the terms of the commercial lease arrangement at that point in time.
